1. Introduction

Welcome to Via Vante Tours (“Via Vante”, “we”, “us” or “our”).

These Terms & Conditions govern the use of our website and the booking and provision of our private transport, chauffeur services, airport transfers and private tours in Cape Town, the Western Cape and other destinations where our services are offered.

By submitting a booking request, accepting a quotation or confirming a booking with Via Vante, you agree to these Terms & Conditions.

Please read them carefully before confirming your booking. Any specific conditions communicated and agreed upon for an individual booking will apply alongside these general terms.

2. Our Services

Via Vante offers private transport and travel experiences, which may include:

  • Private chauffeur services.

  • Point-to-point transport.

  • Airport pick-ups and drop-offs.

  • Hourly chauffeur bookings.

  • Event and occasion transport.

  • Long-distance journeys.

  • Private tours and sightseeing experiences.

  • Optional transport arrangements associated with tours and activities.

All services are subject to availability, vehicle suitability, operational requirements and confirmation by Via Vante.

We aim to provide comfortable, reliable and professional services. However, routes, schedules and travel times may be affected by traffic, weather, road closures, safety considerations and other circumstances beyond our reasonable control.

3. Enquiries and Bookings

Submitting an enquiry or requesting a quotation does not constitute a confirmed booking.

A booking will be considered confirmed once Via Vante has accepted the booking, communicated the agreed service details and received any required deposit or payment specified in the quotation.

Customers are responsible for providing accurate booking information, including:

  • Full name and contact details.

  • Travel date and required pick-up time.

  • Pick-up and drop-off locations.

  • Number of passengers.

  • Luggage requirements.

  • Relevant flight information for airport transfers.

  • Tour preferences and any special requirements.

Any changes to the information supplied must be communicated to Via Vante as soon as reasonably possible.

Via Vante reserves the right to decline a booking where the requested service cannot reasonably or safely be provided.

4. Quotations and Pricing

All quotations are based on the information provided by the customer and the agreed service requirements.

Prices will be communicated before the booking is confirmed. Unless expressly stated otherwise, a quotation covers only the services specifically listed in it.

Additional charges may apply where the customer requests changes or additional services, including:

  • Extended waiting times.

  • Additional driving hours or destinations.

  • Significant route changes.

  • Additional stops not included in the original quotation.

  • Additional vehicle or passenger requirements.

  • Parking fees, toll fees or other agreed expenses not included in the quoted price.

Any additional charges will be communicated to the customer for approval wherever reasonably practicable.

Quotations are valid for the period stated in the quotation. If no validity period is stated, Via Vante may need to reconfirm the price and availability before accepting the booking.

5. Deposits and Payments

Payment terms will be communicated to the customer before the booking is confirmed.

Depending on the service, Via Vante may require a deposit, full payment in advance or another agreed payment arrangement.

Customers must make payments by the agreed deadlines and through the payment methods communicated by Via Vante.

A booking may be cancelled if the required payment is not received by the agreed deadline, subject to applicable law and any cancellation terms communicated for that booking.

Where a deposit is required, the quotation or booking confirmation will specify the amount, payment deadline and applicable refund conditions.

All payments, deposits and refunds will be handled in accordance with the agreed booking terms and applicable South African law.

6. Cancellation Policy

We understand that travel plans may change. Customers who need to cancel a booking should notify Via Vante as soon as possible in writing, by email or through another agreed communication channel.

The following principles apply:

6.1 Cancellation by the Customer

The cancellation terms applicable to the booking will be communicated before confirmation and will specify any notice periods, cancellation charges and refund conditions.

The amount refundable may depend on the notice provided, the type of service booked, expenses already incurred and any non-refundable third-party reservations.

Where a cancellation fee applies, it must be consistent with the terms disclosed to the customer and applicable law.

Via Vante's cancellation schedule:

  • Cancellation more than [insert number] hours before departure: [insert applicable fee or refund terms].

  • Cancellation within [insert number] hours of departure: [insert applicable fee or refund terms].

  • No-show or cancellation after the agreed departure time: [insert applicable fee or refund terms].

These time periods and charges must be completed and communicated before this policy is published or used for bookings.

6.2 Deposits and Refunds

Deposits are subject to the cancellation terms communicated at the time of booking and applicable law. A deposit will not automatically be treated as non-refundable in every circumstance.

Where a refund is due, Via Vante will process it within a reasonable period, subject to any necessary payment-provider procedures.

The applicable booking terms and circumstances must justify any lawful deductions.

6.3 Cancellation by Via Vante

If Via Vante must cancel a confirmed booking and cannot provide a suitable alternative acceptable to the customer, the customer will be offered the applicable refund or other remedy required by the booking terms and South African law.

Where reasonably possible, Via Vante will notify the customer promptly and discuss alternative arrangements.

6.4 Unforeseen Circumstances

Where a booking is affected by severe weather, road closures, safety concerns, government restrictions or other circumstances beyond reasonable control, Via Vante will communicate with the customer and attempt to find a reasonable alternative.

Any cancellation, rescheduling or refund will be handled in accordance with applicable law and the circumstances of the booking.

7. Rescheduling and Booking Changes

Customers should request changes to a booking as early as possible.

Changes to dates, times, destinations, passenger numbers, routes or service duration are subject to availability and Via Vante's approval.

Changes may result in an adjusted quotation or additional charges. No change is guaranteed until Via Vante confirms it.

Where a requested change cannot be accommodated, the original booking terms, including the applicable cancellation provisions, will continue to apply.

8. Airport Transfers and Waiting Times

Customers booking airport transfers must provide accurate flight details, arrival information and contact details where requested.

Customers should notify Via Vante promptly of flight delays, cancellations, changes or other disruptions.

Airport waiting-time arrangements, including any complimentary waiting period and additional waiting charges, will be communicated during booking.

Where a customer cannot be located or contacted after the agreed waiting period, Via Vante may treat the booking as a no-show, subject to the disclosed booking terms and applicable law.

Via Vante will make reasonable efforts to accommodate flight delays where operationally possible, but cannot guarantee availability beyond the agreed service period.

9. Private Tours and Third-Party Activities

Via Vante offers private tours that may be customised around the customer's preferred attractions, destinations, restaurants and activities.

The customer is responsible for reviewing the proposed itinerary and confirming the selected services before the tour.

Unless expressly included in the quotation, the tour price does not automatically include:

  • Attraction or museum entrance fees.

  • Wine tastings.

  • Restaurant meals and beverages.

  • Activities, excursions or equipment hire.

  • Personal purchases or other incidental expenses.

Where Via Vante arranges bookings with third-party attractions, restaurants, wineries or activity providers, those services may be subject to the third party's own availability, payment, cancellation and refund terms.

Any applicable third-party conditions will be communicated where reasonably practicable. Via Vante will assist with relevant arrangements but cannot guarantee a third party's availability, performance or refund decision.

Customers remain responsible for any third-party costs they have agreed to pay, subject to the applicable terms and law.

10. Passenger Responsibilities

Customers and passengers are expected to:

  • Be ready at the agreed pick-up location and time.

  • Provide accurate information relevant to the journey.

  • Treat drivers, vehicles and other passengers respectfully.

  • Follow reasonable safety instructions provided by the driver.

  • Wear seat belts and comply with applicable road-safety requirements.

  • Ensure that children are appropriately supervised and secured in accordance with applicable law.

  • Inform Via Vante in advance of significant luggage requirements or special assistance needs.

  • Avoid conduct that endangers the driver, passengers or other road users.

Passengers must not engage in unlawful, threatening, abusive or dangerous behaviour during a journey.

Via Vante may refuse or discontinue a service where passenger conduct creates a genuine safety risk or makes it unreasonable to continue. Any resulting charges or refunds will be assessed in accordance with the booking terms and applicable law.

11. Vehicles and Passenger Capacity

Vehicle allocation will depend on availability, the number of passengers, luggage requirements and the nature of the service.

Customers must disclose passenger numbers and relevant luggage requirements when booking.

No vehicle may carry more passengers than its permitted capacity. Larger vehicles may be arranged upon request but are subject to availability and may involve additional charges.

Via Vante may arrange a suitable replacement vehicle where necessary, provided the replacement is reasonably appropriate for the agreed service.

12. Delays and Travel Times

Estimated journey times are provided for planning purposes and are not guaranteed.

Traffic congestion, roadworks, accidents, adverse weather, road closures and other unforeseen circumstances may affect arrival times.

Via Vante will make reasonable efforts to complete journeys according to the agreed schedule but cannot guarantee exact arrival times where delays are outside its reasonable control.

Customers should allow sufficient travel time for flights, events, appointments and other time-sensitive commitments.

13. Lost Property and Vehicle Damage

Customers are responsible for their personal belongings during the journey.

Via Vante will make reasonable efforts to assist in locating and returning items left in a vehicle, but cannot guarantee that lost property will be recovered.

Customers may be held responsible for damage to a vehicle caused by their intentional or negligent actions, subject to applicable law and a fair assessment of the circumstances.

Any charges for damage must be reasonable and supported by appropriate evidence.

14. Liability

Via Vante will exercise reasonable care and skill in providing its services.

Nothing in these Terms & Conditions excludes or limits any liability, consumer right or remedy that cannot lawfully be excluded or limited under South African law.

Subject to those legal protections, Via Vante will not be responsible for losses arising solely from circumstances beyond its reasonable control, including traffic disruptions, severe weather, road closures or third-party service interruptions.

Where a loss is caused by Via Vante's breach of contract, negligence or other actionable conduct, liability will be determined in accordance with applicable law.

Customers remain responsible for their own decisions, personal belongings and compliance with applicable laws and safety instructions.

15. Force Majeure

Neither party will be considered in breach solely because an event beyond its reasonable control prevents or materially delays performance of an obligation.

Such events may include severe natural events, public emergencies, civil unrest, government restrictions, major road closures or other comparable disruptions.

The affected party should notify the other party as soon as reasonably practicable. Both parties will make reasonable efforts to reduce the impact and agree on suitable alternatives where possible.

Any payments, refunds, rescheduling or cancellation rights remain subject to applicable law and the specific booking terms.

16. Privacy and Personal Information

Via Vante collects and processes personal information to respond to enquiries, manage bookings, arrange journeys, process payments and provide customer support.

Personal information will be handled in accordance with our Privacy Policy and applicable data-protection legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA).

Customers can consult the Privacy Policy on our website for further information about the collection, use, storage and sharing of their personal information.

17. Website Content and Intellectual Property

Unless otherwise stated, content created for Via Vante's website, including text, branding, logos and original imagery, is owned by Via Vante or used with appropriate permission.

Website content may not be reproduced, distributed or used commercially without the relevant permission, except where permitted by law.

We aim to keep website information accurate and current but do not guarantee that every description, image or piece of information will remain accurate or available at all times.

18. Complaints and Dispute Resolution

If a customer has a complaint concerning a booking or service, they should contact Via Vante as soon as reasonably possible and provide relevant details.

We will make reasonable efforts to investigate the concern and work towards a fair resolution.

Where a dispute cannot be resolved directly, either party may pursue the remedies available under applicable South African law.

Nothing in this section prevents a customer from exercising any statutory rights or lodging a complaint with an appropriate regulatory body.

19. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with by a competent South African court or other appropriate forum in accordance with applicable law.

Nothing in these Terms & Conditions removes any consumer protection or legal remedy available to a customer under South African law.

20. Amendments to These Terms

Via Vante may update these Terms & Conditions from time to time to reflect changes to its services, operations or legal requirements.

The current version will be published on our website with its effective date.

Changes will not automatically override terms already agreed for a confirmed booking. Any changes affecting an existing booking will be handled in accordance with the original agreement and applicable law.
